AirCompair Member Terms and Conditions

These terms and conditions are between AirCompair.com, herein called AirCompair, and the member who purchases an AirCompair membership, herein called member. The Terms and Conditions included within dictate the rules and policies that are applicable for the term of the membership period that the member purchases from AirCompair. AirCompair does not operate any charter aircraft of its own. AirCompair provides information about different charter operators and aircraft, and facilitates the relationship between the member and the selected charter operator. AirCompair does not contract for charter services directly from any charter operator. All contracts for travel services are entered into directly between the member and the selected charter operator.

The membership period for AirCompair is for one (1) year, or 365 calendar days, except for the Trial Membership, which is active for one (1) charter request. There are three separate membership types; Trial Membership, Individual/Small Business, and Corporate.

Trial Membership:The membership fee for a trial membership is $295.00 and provides access to all of AirCompair’s on-line services for one (1) charter request. Individuals selecting a trial membership will be able to subsequently sign up for a regular membership (Individual or Corporate) and will be credited the Trial Membership payment when signing up for full membership privileges.

Individual/Small Business Membership: Annual membership fee is $1295.00 and includes one year of membership. The Individual/Small Business member gets one user name to access the AirCompair website. The member gains access to AirCompair’s itinerary builder, the AirCompair charter search engine, unlimited charter requests, and the ability to receive wholesale charter rates provided by participating charter operators specifically for AirCompair members, plus all other additional features available from the AirCompair website. Brokers signing up for AirCompair services must sign up for corporate membership.

Corporate Membership: Annual membership fee is $3995.00 and includes one year of membership. The Corporate member gets up to ten (10) user names for access to AirCompair’s website by multiple users. The Corporate member gains access to AirCompair’s itinerary builder, the AirCompair charter search engine, unlimited charter requests, and the ability to receive wholesale charter rates provided by participating charter operators specifically for AirCompair members, plus all other additional features available from the AirCompair website. Corporate members also receive a detailed charter usage analysis that studies the needs of the corporation and provides logistical support to secure the best charter services based upon the specific needs of the company. Brokers signing up for AirCompair services must sign up for corporate membership.

Both Individual and Corporate members are guaranteed to always receive the lowest available industry wholesale charter rate for aircraft hourly rates as supplied by the selected charter operator. Charter operator aircraft displayed via the AirCompair charter search engine will always display the provided discount, which is a minimum of five percent (5%) off the retail hourly aircraft rates. The discount is applied to aircraft flight charges only. Other charges not limited to: crew fees, fuel surcharges, landing fees, airport charges, catering charges, entertainment or meal expenses, or other miscellaneous fees are not subject to discounted rates. Charter operators will disclose all charges when contracted by the AirCompair member for charter services.

Individual/Small Business members are guaranteed to save at least the cost of the AirCompair membership in their initial membership period. If the savings accrued by the member is less than the cost of the initial year’s membership, the member will receive a rebate offer to be provided for the next year’s membership. The member can also request that the rebate be paid back directly to the member if they choose not to renew their membership for the upcoming year. The total savings achieved to date by the member will be displayed on each member's home account page.

AirCompair guarantees member satisfaction and offers a money-back guarantee if the member ever chooses to cancel their membership. If a request for membership cancellation is received, the member will be credited the membership cost less any savings the member has received for the current year’s membership.

AirCompair generates good faith charter cost estimates for every aircraft that displays on the AirCompair website. These charter estimates are based on price and aircraft performance entries made by each charter operator. All charter estimates are good faith attempts to show the exact cost of the charter, and displays all aspects of how the charter estimate was constructed. Actual hourly aircraft are also provided which are controlling to determine the actual cost of the charter. The official charter quote will be provided by the selected charter company after the member formally requests a charter reservation. Additionally, official charter quotes can be requested by the member prior to contracting for charter services. AirCompair attempts to make the charter cost estimate as accurate as possible, but does not offer any guarantee to the accuracy of the quote until the official charter quote is provided by the selected charter operator. Member savings are based upon the actual charter quote, as provided by the selected charter operator. Discounts provided by AirCompair are not limited to the charter operators displayed on the AirCompair website. If a charter request is arranged with a charter operator not displayed on the AirCompair search engine, AirCompair will secure the wholesale hourly charter rate for the member.

AirCompair is compliant with D.O.T. rules 49 U.S.C. §§ 41101, 41301, and 41712. AirCompair does not operate any charter aircraft, but helps to facilitate the relationship of the charter customer with the selected charter operator. AirCompair does not contract charter services with any charter operators – all contracts for charter services are entered into directly by the member and the selected charter operator. The policies and procedures of the selected charter company are controlling for the disposition of the charter, and AirCompair is not responsible for the conduct of the charter. AirCompair displays aircraft information on behalf of the charter operators that have entered information on the AirCompair website, but is not responsible for any errors or omissions made by the charter operator. No charter estimate or charter reservation request is official until the member contracts the selected charter operator for charter services. All payment for charter services is made directly between the member and the selected charter operator, and AirCompair does not act as third party for billing or contract services for the charter. AirCompair forwards the requested itinerary to the selected charter operator, but the itinerary is not official until agreed upon and contracted to with the selected charter operator. Discounts provided by AirCompair are not limited to the charter operators displayed on the AirCompair website. If a charter request is arranged with a charter operator not displayed on the AirCompair search engine, AirCompair will secure the wholesale hourly charter rate for the member.

Aircraft availability is always changing. Aircraft displayed on the AirCompair website are not guaranteed available until after the member has requested a charter, and the charter has been accepted by the selected charter operator. AirCompair has provided each charter operator with the ability to control availability of every aircraft that displays on the AirCompair website, but cannot guarantee the accuracy of the entries. AirCompair is always working to ensure accurate aircraft availability and pursues every option to maintain accurate availability display. If the selected aircraft is not available at the time of the charter request, AirCompair will contact the member to discuss and arrange for alternate plans. Additionally, AirCompair is not responsible for aircraft availability after the charter has been accepted by the selected charter operator. All charter operator policies and procedures are controlling as contracted by the member and the selected charter operator. AirCompair, in most cases, will find the member an available aircraft if the charter request is made at least 24 hours in advance of planned departure time of the requested itinerary. If AirCompair fails to find an adequate charter aircraft for the member with more than 72 hours notice, AirCompair will refund the member the AirCompair membership fee less any savings the member has received in the membership period and cancel the membership if requested to do so. With less than 24 hours notice, AirCompair cannot guarantee aircraft availability, but will always work to find the member an aircraft and charter operator to fulfill the charter request. AirCompair members are encouraged to make charter requests early, especially for high demand travel periods (sporting events, political events, holidays, etc.).

AirCompair maintains all member information in strict confidence, and does not share personal information with any outside entity or organization. The member’s identity is only provided to the selected charter operator after the charter operator agrees to the charter request. All credit card transactions made on the AirCompair website are secure and encrypted using the latest technology provided by Card Service International, Inc., and Verisign, Inc. AirCompair requests credit card information for charter requests as a method to reserve the requested aircraft on behalf of the AirCompair member, but will not provide any credit information to the selected charter operator until the operator has accepted the pending charter request. All payments for charter services will be made directly by the member with the selected charter operator, and AirCompair will not contract or receive payment for any charter services.
